The meeting was called to order by Wendy at 7:03 p.m.

 

Secretary's Report

The minutes of the May 2023 Board meeting were read in advance by Trustees.  Carol made a motion, seconded by Wendy, that the minutes be approved.  The motion was approved by a vote of 7-0.

Old Business

 

Maintenance/Repair of Jackson Rd. and Gunn Hwy. Walls

 

  • Improvements to Jackson Rd. Wall – Penny saw workers reconstructing a small section of wall for a subdivision on Lowell Rd. and asked for contact information in order to get a cost estimate on the additional repairs needed for the Jackson Rd. wall.  The owner of Carlson Construction, Inc. met with Penny, Wendy, and Allen to review what repair work was needed.  However, when he looked at the County property map and saw that the wall was on private property, he advised them that he could not give the Board an estimate and would have to work directly through the property owners.

 

  • Repair of Gunn Hwy. Wall – Barbara had not heard back from Perry Mallory of T-3 Construction.  This topic was tabled until a future Board meeting.

 

Board’s Responsibility Under Ordinance #87-53 for Maintenance/Repair of Walls Not Owned by

District – Penny emailed Mary Mahoney, County Management & Budget, to inquire about the Board’s responsibility in this regard.  She responded that the County Attorney’s Office does not provide legal interpretations for Districts and that the Board would need to hire an attorney for a legal opinion on the matter.   However, she also responded that District funds are for the maintenance and improvement of public right-of-ways, and, traditionally, this extends to the maintenance of the walls, but only the sides facing a public road or right-of-way and only for cosmetic repairs and maintenance (e.g., pressure washing, sealing, painting, minor repairs to the “public” side).  Even then, an individual property owner can object to those District activities because it is still private property.  When it comes to major repairs such as reconstructing part of a wall, unless the District actually owns the wall, the County’s position has been that the District has no standing to fund this, since District funds cannot be expended when it is private property. 

 

Notice to Homeowners with Property Adjacent to Walls – In light of the information received from Mary Mahoney, it was agreed by Trustees that a notice to homeowners should not be pursued at this time.

 

New Business

 

Submission of Statement of Financial Interests (Form 1) to County Supervisor of Elections – Trustees were reminded that this form must be completed and received by the Supervisor of Elections by July 3, 2023.

 

Public Records Request – Barbara received a request for “an electronic copy of all payment transactions for fiscal year 2022” from a representative of American Transparency in Boca Raton.  Barbara provided a spreadsheet by email with all fiscal year 2022 expenditures.

 

There being no further business, Penny made a motion, seconded by Wendy, that the meeting be adjourned at 7:27 p.m. The motion was approved by a vote of 7-0.
